Terms of Service

• "Service" means the BUSAMA Entertainment website, recruitment portal, and associated database systems.
• "Talent" or "Contractor" refers to individuals (Dancers, Strippers, Entertainers) using the Service to seek bookings or agency representation.
• "Venue" or "Client" refers to Gentlemen's Clubs, promoters, or entities using the Service to scout or book Talent.
• "Content" means text, images, video, and data upload to the Service.

3.1 Age Restriction: You represent and warrant that you are at least eighteen (18) years of age, or the age of majority in your jurisdiction, whichever is greater. Access to this Service by anyone under the age of 18 is STRICTLY PROHIBITED.

3.2 Verification: BUSAMA Entertainment reserves the right to request valid, government-issued photo identification (Passport, Driver's License) at any time to verify age and identity. Failure to provide such documentation will result in immediate termination of services.

3.3 Right to Work: By applying, Talent warrants they hold the legal right to work in the jurisdiction where they are seeking bookings (e.g., Valid Visa for Australia/NZ/USA/EU).

4.1 Non-Employment Relationship: Unless expressly stated in a separate written Employment Contract, all Talent utilizing BUSAMA Entertainment services are classified as Independent Contractors and not employees of BUSAMA Entertainment.

4.2 Responsibilities: As an Independent Contractor, you constitute your own business entity. You are solely responsible for:

• Reporting and paying all applicable taxes (Income Tax, GST/VAT) in your jurisdiction.
• Providing your own insurance (Liability, Health, Accident).
• Complying with local licensing requirements (e.g., Adult Entertainment Licenses).

4.3 No Agency (Legal): Except for the limited purpose of booking logistics as outlined in specific Agency Agreements, these Terms do not create a partnership, franchise, joint venture, agency, fiduciary, or employment relationship between the parties.

5.1 Professionalism: Users agree to conduct themselves with high standards of professionalism. Intoxication, drug use, or aggressive behavior at affiliated Venues is grounds for immediate removal from the BUSAMA platform.

5.2 Zero Tolerance Policy: BUSAMA Entertainment maintains a ZERO TOLERANCE policy regarding:

• Prostitution/Solicitation: Any solicitation of sexual acts for money (outside of lawful adult entertainment performance parameters defined by local law) is strictly prohibited.
• Human Trafficking: We cooperate fully with international law enforcement regarding any suspicion of coercion or trafficking.
• Illegal Substances: Possession or distribution of illegal narcotics is prohibited.

5.3 Consent: All physical interactions within the scope of bookings must be consensual and adhere to the strict "Look but don't touch" or "Touch" policies of the specific Venue where the booking occurs.

6.1 Agency Fees: Venues/Clients agree to pay the fees stipulated in their specific Service Activation Agreement.

6.2 Talent Earnings: Talent earnings are determined by the specific Venue or Booking contract. BUSAMA Entertainment is not liable for unpaid wages by third-party Venues, though we will advocate on behalf of our Talent.

6.3 Refunds: All listing fees, directory fees, and agency service fees are non-refundable unless otherwise stated in writing.

7.1 License to Use: By uploading photos, videos, or resumes ("Talent Materials"), you grant BUSAMA Entertainment a worldwide, non-exclusive, royalty-free license to use, display, and reproduce these materials for the purpose of promoting you to potential Venues.

7.2 AI & Scraping: The use of automated systems, AI agents, or scrapers to harvest data from our directory without express written permission is STRICTLY PROHIBITED and will result in legal action.

8.1 High-Risk Industry: You acknowledge that the adult entertainment industry involves inherent risks. BUSAMA Entertainment screens Venues but cannot guarantee your physical safety or the conduct of third parties/patrons. You assume all risks associated with your work.

8.2 "As Is": The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted or error-free.

8.3 Liability Cap: To the maximum extent permitted by law, BUSAMA Entertainment's total liability for any claim arising out of these terms shall not exceed the amount paid by you to BUSAMA Entertainment in the past six months, or AUD $100.00, whichever is greater.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BUSAMA Entertainment Limited is domiciled, without regard to its conflict of law provisions.

• Australia: Compliance with the Competition and Consumer Act 2010 (Cth).
• New Zealand: Compliance with the Consumer Guarantees Act 1993.
• European Union: We adhere to GDPR standards regarding data privacy.
• USA: Services provided in the USA adhere to relevant State and Federal independent contractor guidelines.
